California RPA Escrow Timeline: The 17-Day Milestone Checklist Every Agent Needs

Every top-producing agent knows the feeling: the offer gets accepted, excitement hits, and then reality sets in. Within hours, the clock starts ticking on dozens of contractual deadlines across escrow, disclosures, physical inspections, and lender milestones.

Under the standard California Residential Purchase Agreement (C.A.R. Form RPA), missing a single deadline can trigger a Notice to Buyer to Perform (NBP) or Demand to Close Escrow (DCE)—or worse, leave your client’s deposit at risk.

Whether you are managing your own files or looking to tighten your workflow, keep this milestone checklist handy from the moment contract acceptance is signed.

Days 1–3: The Launch Phase

The first 72 business hours dictate the rhythm of the entire escrow. Clear communication here prevents confusion later.

  • Secure & Verify Contract Documents: Gather the fully executed RPA, all Counter Offers, and any associated Addenda (e.g., Seller License to Remain in Possession or Trust Advisory).

  • Open Escrow & Order Prelim: Deliver the full contract package to your chosen escrow and title officer. Request the preliminary title report immediately.

  • Initial Earnest Money Deposit (EMD): Under standard terms, the buyer has 3 business days from acceptance to wire the EMD to escrow. Verify wire fraud advisory receipts before any funds move.

  • Establish Key Contacts: Distribute a contact sheet linking escrow, title, the co-op agent, the lender, and your transaction coordination team.

Days 4–7: Seller Disclosures & Reports

Statutory and contractual disclosure requirements are heavily front-loaded in California escrows.

  • Seller Disclosure Delivery Window: The seller typically has 7 calendar days after acceptance to deliver all statutory and contractual disclosures to the buyer.

  • Core Statutory Packets: Ensure delivery and tracking of:

    • Transfer Disclosure Statement (TDS) & Seller Property Questionnaire (SPQ)

    • Natural Hazard Disclosure (NHD) Report & Environmental Advisories

    • Lead-Based Paint Disclosure (if built prior to 1978)

    • Statewide Buyer and Seller Advisory (SBSA)

    • HOA Governance, By-laws, and Budget Packages (if applicable)

  • Title Review: Review the preliminary title report for unexpected liens, solar lease UCC filings, or unrecorded easements.

Days 8–17: Investigations & Contingency Tracking

This is the most time-sensitive phase of the transaction. By default, the California RPA provides a 17-day window for buyer investigations unless altered by contract addenda.

  • Physical Inspections: Schedule and complete general home, termite, roof, sewer, and specialty inspections early to leave ample room for repair negotiations.

  • Request for Repair (RR / RRRR): If negotiating repairs or credits, submit requests well before Day 17 to allow the seller time to respond without risking contractual performance deadlines.

  • Appraisal Tracking: Check in with the buyer’s lender to confirm the appraisal is scheduled, completed, and received on value.

  • Contingency Removal #1 (Day 17):

    • Physical Inspection Contingency: Buyer delivers Form CR (Contingency Removal) covering physical inspections and property condition.

    • Appraisal & Loan Contingencies: Verify whether the transaction used the default 17-day loan/appraisal contingency or custom terms before drafting the CR form.

  • Agent Visual Inspections (AVID): Both listing and selling agents must complete and exchange their three-page Agent Visual Inspection Disclosures.

Days 18–30+: Approaching the Finish Line

With contingencies removed, focus shifts entirely to loan finalization, closing compliance, and property handover.

  • Loan Funding Documents: The lender prepares and releases final loan documents for buyer signing (notarized).

  • Final Verification of Condition (VP): Schedule the buyer walk-through within 5 days prior to close of escrow to confirm completed repairs and property condition.

  • Broker Compliance Sign-Off: Ensure every DRE-mandated advisory, receipt, escrow instruction, and commission instruction is uploaded and approved by your managing broker.

  • Escrow Close & Recording: Escrow confirms receipt of final buyer down payment funds, lender loan proceeds, and records the grant deed with the county.
